Terms of Use

1. Definitions

• User Account / Account: The account tied to your email address.
• Inactive Account: A User Account unused or not logged into for 6 months or another period determined by the company.
• Intellectual Property Rights: All IP rights worldwide, including patents, copyright, circuit layout rights, registered designs, trademarks, and confidential information rights, plus applications for registration.
• Lumin: Stash Gaming Pty Ltd (ABN 44 661 609 669), trading as lumin.gg.
• User: Any individual who visits or uses the App.
• User Contract: This User Agreement, the Code of Conduct, and other incorporated materials.
• Lumin App / App: Web, mobile, and desktop applications via Google Play Store, Apple App Store, lumin.gg website, and related services.

2. Agreement

By accessing the Lumin App, you accept these terms. The company may amend the User Agreement and linked information by posting updated terms without notice. The company may change or add App features without obligation to keep it current and assumes no liability for errors or outdated information.

3. Scope

Users must read the entire User Agreement, App policies, linked information, and Privacy Policy before use. Additional terms may apply to specific features.

4. Eligibility

You cannot use the Lumin App if you:

• Cannot form legally binding contracts
• Are under 13 years old
• Are barred from services under Australian or applicable law
• Are suspended from the Website
• Do not have a valid email address

Login credentials should not be shared. The account holder bears responsibility for all account actions. Users aged 13–18 may use an adult’s account with permission, but the account holder remains responsible. The company may refuse registration at its discretion. You cannot transfer or assign rights without written consent.

5. Using the Lumin App

You will not:

• Infringe laws, third-party rights, or company policies
• Post false, misleading, defamatory, or offensive content
• Transfer your account without consent
• Distribute spam, unsolicited communications, chain letters, or pyramid schemes
• Distribute viruses or harmful technology that may damage the App, users’ property, or Intellectual Property Rights
• Download and aggregate listings for display elsewhere without permission
• “Frame,” “mirror,” or incorporate App content into other websites without authorization
• Modify, translate, decompile, disassemble, or reverse engineer company software
• Copy, modify, or distribute App content, copyrights, or trademarks
• Harvest user information without consent
• Use Lumin to facilitate money exchange, including cryptocurrency

6. Intellectual Property Rights Infringement

The company responds to clear notices of alleged IP infringement. Report violations via the Website for investigation.

7. Content

The company does not claim ownership of User Content but grants itself a non-exclusive, sublicensable, irrevocable, and royalty-free worldwide license to use, reproduce, transmit, publish, display, distribute, modify, adapt, and exploit such content in all formats without further notice or payment.

Users acknowledge that:

• The company acts only as a forum for content distribution
• The company has no warranty regarding content availability
• The company may take action regarding User content at its discretion
• The company bears no responsibility for content deletion or storage failure
• All submitted content is subject to company approval

Users represent and warrant their content:

• Does not infringe copyright, patent, trademark, or other IP rights
• Does not violate laws or regulations
• Is not defamatory
• Is not obscene or contain child pornography
• Does not involve missiles, nuclear, chemical, or biological weapons
• Does not link to terrorist activities
• Contains complete, accurate, and truthful information
• Contains no malware or harmful code

The company may transfer personal information to related entities and outside Australia or the EEC area. Users may withdraw consent but acknowledge potential service restrictions or account closure.

App information on legal, financial, health, and other matters is not professional advice. Third-party content and links are provided as-is; the company assumes no liability for them. The company does not control or endorse linked websites. Content deletion does not imply permanent removal; information may be retained for compliance and legal purposes.

8. Advertising

Users must not advertise external websites, products, or services without prior written agreement. The company displays advertisements without responsibility for losses resulting from them or subsequent third-party dealings. Advertisement content is protected by IP laws; users must not modify or create derivative works without authorization.

9. Communication With Other Users

Lumin may use your name, location, username, and profile image for messaging services. The company may read correspondence and access uploaded files to investigate fraud, abuse, and risk management.

10. Inactive Accounts

The company reserves the right to close Inactive Accounts.

11. Right to Refuse Service

The company may close, suspend, or limit account access without reason, including if:

• The user breaches this User Agreement
• The user infringes legal rights or IP rights
• The user engages in fraudulent or illegal activities
• The user is subject to sanctions or banking restrictions preclude business
• To manage loss risks
• For other reasons

Breaching users must pay all owed fees and reimburse investigation and collection costs. The company acknowledges breach damages are substantial and may fine users up to US$3,000 per breach or pursue legal action. The fine is deemed a reasonable pre-estimate of damages. The company may withdraw fine amounts from user accounts.

If the company closes an account for non-breach reasons, users receive any due payments. Account closure entails no claims against the company.
